Terms of Service
Please read these Terms carefully. They contain important disclaimers, limits on liability, a class action waiver, a jury trial waiver, and a shortened time to bring claims, to the fullest extent permitted by law.
1. Acceptance of these Terms
These Terms of Service are a binding agreement between you and Find a Hoop, referred to as "Find a Hoop," "we," "us," or "our." They govern your access to and use of this website, its directory, maps, application programming interfaces, forms, content, advertising, and related services, collectively the "Service." By accessing or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You may use the Service only if you can legally enter into this agreement. If you are under the age of majority where you live, you may use the Service only with the involvement and permission of a parent or legal guardian. You must be at least 18 years old, or the age of majority where you live, to submit content on behalf of an organization.
2. Directory only, not an endorsement
Find a Hoop is an informational directory. We do not own, operate, supervise, certify, sponsor, control, or endorse the leagues, games, facilities, courts, organizers, coaches, participants, businesses, advertisers, or other third parties listed, promoted, or linked through the Service. A listing, badge, ranking, advertisement, sponsorship, or link does not mean that we have inspected, approved, screened, or verified any person, program, facility, price, schedule, registration status, insurance coverage, background check, accessibility feature, safety practice, claim, or legal compliance.
Directory information can be incomplete, inaccurate, unavailable, outdated, duplicated, or changed without notice. Labels such as "active," "verified," "stats and highlights," and similar descriptions reflect available directory data and do not guarantee current registration, quality, legitimacy, availability, or performance.
3. Your responsibility and assumption of risk
You are solely responsible for independently confirming every detail with the relevant organizer before relying on a listing, paying money, traveling, registering, attending, sharing personal information, or participating. You are also responsible for evaluating whether an activity, location, organizer, coach, advertiser, product, or participant is appropriate for you or a child in your care.
Basketball, travel, in-person meetings, and use of athletic facilities involve risks, including property loss, fraud, illness, bodily injury, disability, and death. To the fullest extent permitted by law, you voluntarily assume all risks arising from your use of the Service and any activity or interaction you discover through it. Find a Hoop is not a party to any transaction, registration, waiver, payment, dispute, or relationship between you and a third party.
The Service does not provide legal, medical, safety, financial, emergency, or other professional advice. In an emergency, contact appropriate emergency services.
4. Third-party services and advertising
The Service may display or link to third-party websites, maps, registration systems, social networks, payment services, advertisements, sponsored listings, affiliate offers, products, content, or resources. We may receive compensation, commissions, referral fees, data, services, or other value from third parties. Paid placement or compensation does not create a warranty or make us responsible for the third party.
Third parties, including analytics providers, operate under their own terms and privacy practices. We do not control and are not responsible for third-party content, advertising claims, conduct, security, availability, accessibility, products, services, charges, losses, or data practices. Any purchase, registration, communication, or dispute is solely between you and the third party. You access and use third-party services at your own risk.
5. Permitted and prohibited use
We give you a limited, revocable, nonexclusive, nontransferable license to access and use the Service for lawful, personal, noncommercial directory purposes, subject to these Terms. Ordinary search engine indexing and reasonable use of our documented public API are permitted.
You may not, and may not help anyone else to:
- violate a law, regulation, court order, contract, intellectual property right, privacy right, publicity right, or other right;
- submit false, misleading, unlawful, infringing, harassing, malicious, or unauthorized content;
- impersonate another person or misrepresent your identity, authority, affiliation, or ownership of a listing;
- interfere with, disrupt, overload, probe, scan, test, bypass, or compromise the Service or its security, access controls, or rate limits;
- introduce malware, scrape personal contact information, send spam, or use the Service for surveillance or unlawful discrimination;
- copy, republish, resell, sublicense, or commercially exploit a substantial portion of the directory, or use it to create or improve a competing directory, database, product, or service, without our written permission;
- reverse engineer or attempt to extract source code except to the limited extent a restriction is prohibited by law; or
- use automated means in a way that is abusive, excessive, deceptive, or inconsistent with published technical instructions.
6. Submissions and feedback
If you submit a listing, correction, description, link, image, feedback, or other material, you represent and warrant that your submission is accurate, lawful, nonconfidential, and that you have all rights and permissions needed to provide it and grant the license below.
You keep any ownership rights you have in your submission. You grant Find a Hoop a worldwide, perpetual, irrevocable, royalty-free, fully paid, transferable, sublicensable license to host, store, reproduce, modify, adapt, translate, publish, create derivative works from, distribute, publicly display, communicate, advertise with, and otherwise use the submission for operating, promoting, monetizing, protecting, improving, or providing the Service and related products in any format or medium. You waive, and agree not to assert, moral rights or similar rights to the extent permitted by law.
We may verify, edit, combine, reclassify, reject, remove, restore, or decline to publish any submission at any time, with or without notice, for any reason or no reason. We are not required to monitor submissions, preserve them, respond to them, compensate you for them, or treat them as confidential. You are responsible for your submission and any consequences of it.
7. Our content and intellectual property
The Service, including its branding, design, arrangement, software, text, graphics, and original content, is owned by or licensed to Find a Hoop and is protected by applicable intellectual property laws. Except for the limited license in these Terms, no right, title, or interest is transferred to you. Third-party names, marks, and content remain the property of their respective owners. You may not use Find a Hoop names, logos, or marks without our prior written permission.
8. Analytics, experiments, and monetization
We use Google Analytics 4 to measure use of the Service, understand traffic and engagement, troubleshoot performance, and improve the site. Google Analytics may process usage, device, browser, referral, session, and approximate location information as described in our Privacy Policy and Google's terms. Our implementation uses Google Consent Mode, keeps advertising storage and advertising user data disabled, and disables Google Signals and advertising-personalization signals. If you allow analytics storage, Google Analytics may use first-party cookies or similar identifiers. Limited consent-state and cookieless measurements may be transmitted when analytics storage is denied.
We may change analytics providers, test or personalize features, and use cookies, pixels, local storage, device identifiers, or similar technologies as described in the Privacy Policy. We may also introduce, change, or remove advertisements, sponsored placements, affiliate links, subscriptions, paid features, fees, or other forms of monetization. We may determine the placement, labeling, selection, ranking, and availability of these features at our discretion, subject to applicable law and any required notice or choice.
9. Changes, suspension, and termination
We may add, change, restrict, suspend, withdraw, discontinue, or remove any part of the Service, directory, API, feature, listing, or content at any time, with or without notice. We may impose or change limits, block requests, or terminate access if we believe you violated these Terms, created risk, or acted against the interests of the Service or its users. We are not liable for any modification, loss, unavailability, suspension, or termination.
10. Disclaimer of warranties
To the fullest extent permitted by law, the Service and all information, listings, links, maps, advertisements, and content are provided "as is" and "as available," with all faults and without warranties of any kind. Find a Hoop disclaims all express, implied, statutory, and other warranties, including warranties of accuracy, completeness, currency, title, noninfringement, merchantability, fitness for a particular purpose, quiet enjoyment, security, availability, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, error-free, secure, free of harmful components, or that defects or inaccurate listings will be corrected. No statement or information from us creates a warranty unless expressly stated in these Terms.
11. Limitation of liability
To the fullest extent permitted by law, Find a Hoop and its affiliates, licensors, service providers, contributors, advertisers, sponsors, and their respective officers, directors, employees, contractors, agents, successors, and assigns will not be liable for any indirect, incidental, special, exemplary, consequential, enhanced, or punitive damages; loss of profits, revenue, data, goodwill, or opportunity; personal injury; property damage; or costs of substitute services arising out of or related to the Service, a listing, an advertisement, a third party, or these Terms, even if advised that such harm was possible.
To the fullest extent permitted by law, the total aggregate liability of all Find a Hoop parties for every claim arising out of or related to the Service or these Terms will not exceed the greater of: (a) the amount you paid directly to Find a Hoop for the Service during the 12 months before the event giving rise to the claim; or (b) 100 United States dollars.
These exclusions and limits apply to all theories of liability and are an essential basis of the agreement. Some jurisdictions do not allow certain exclusions or limits, so some of them may not apply to you. In that case, liability is limited to the greatest extent the law permits.
12. Indemnification
To the fullest extent permitted by law, you will defend, indemnify, and hold harmless the Find a Hoop parties from and against claims, demands, actions, investigations, liabilities, damages, judgments, settlements, losses, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use or misuse of the Service, your submission, your interaction or transaction with a third party, your violation of these Terms, or your violation of a law or another person's rights. We may control the defense and settlement of any matter subject to indemnification, and you will cooperate with us. You may not settle a matter that imposes liability or obligations on us without our written consent.
13. Disputes, waivers, and time limit
Before filing a claim, you must give us a detailed written notice through Submit a Change, select "Other," identify the notice as a legal dispute, and allow 30 days for an informal resolution. This requirement does not apply where prohibited by law or when immediate injunctive relief is legally necessary.
These Terms and any dispute are governed by the laws applicable at Find a Hoop's principal place of business, without regard to conflict-of-laws principles, except that mandatory consumer protections in your home jurisdiction continue to apply when they cannot lawfully be waived. To the fullest extent permitted by law, exclusive jurisdiction and venue will lie in the state and federal courts that have jurisdiction over Find a Hoop's principal place of business.
To the fullest extent permitted by law, you and Find a Hoop waive any right to a jury trial and agree that each may bring claims only in an individual capacity, not as a plaintiff or class member in a class, collective, consolidated, coordinated, representative, or private attorney general action. If a court finds a particular waiver unenforceable, the remainder of this section and these Terms remain in effect.
To the fullest extent permitted by law, any claim must be filed within one year after the claim arose, or it is permanently barred. If applicable law requires a longer period that cannot be shortened by agreement, the shortest legally permitted period applies.
14. General terms
These Terms and the Privacy Policy are the entire agreement between you and Find a Hoop about the Service and replace prior understandings on that subject. If a provision is held unlawful or unenforceable, it will be enforced to the maximum permissible extent and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them, in whole or part, without restriction. Headings are for convenience only. Provisions that by their nature should survive termination will survive, including submission licenses, disclaimers, liability limits, indemnity, dispute terms, and general provisions.
15. Changes to these Terms
We may update these Terms by posting a revised version and changing the effective date. Changes are effective when posted unless we state otherwise or applicable law requires additional notice. Your continued use after the effective date means you accept the revised Terms. Changes will not reduce rights retroactively where prohibited by law.
